My legal problems

 Why did I put this on my website?  I have lived a good life and I have always been honest and up front with my patients.   Therefore, I would like for my patients to hear my side of this story. 

 I was practicing in Atlanta 10 years ago when I broke my neck in a car wreck.  I was out of work 6 months and thus had to close my practice in Atlanta.  During my recooperation I was  offered a job prescribing viagra and phentermine on the internet with an Atlanta based company, that had been in business for several years.   I received a legal opinion that this was completely legal.   I did a medline search that showed no articles on complications with phentermine (the common diet pill) back to 1984.  I talked with an addictionologist in Atlanta who said he had never seen an addiction to phentermine.   I talked to 3 diet doctors who had each prescribed thousands of phentermine.  They all said it was amazingly safe.  Based on this I took the job for 10 months at $8000 a month.   I also took the job knowing that these medications are available to most of the world without a doctor’s prescription.  The advantage to the patient was they got a free doctor visit and saved the patient a typical 2 hour wait in the doctor’s waiting room.  I reviewed the pertinent medical history and prescribed the medications if indicated.   They were delivered by the company I worked for by the next day. 

 Five years later, I found out that I had been indicted by the US government as a “drug dealer” from the TV news and newspaper in my home town.  I waited for my trial for 2 years, partly because I developed a 12 inch cancer of my right kidney.   I was not given a hint over the previous 5 years that the federal prosecutors had a problem with my actions or the actions of the company I was working for during this time.  Not all doctors that worked for this Atlanta company were indicted.   I was finally charged with a misdemeanor and received  one year of home confinement as a penalty, which has been completed.  

 During this entire ordeal I have continued to practice lasik surgery with thousands of happy patients.   I have done more refractive surgery eyes than any other surgeon in America (115,000).    I have always, and will continue to always, give my patients the best possible care and will be glad to discuss any of the above issues with you in person.
